Terms of Service

These Terms of Service govern your use of Jailhouse Poker, developed and published by 607digital, a studio of Thatcher Enterprises, LLC. By downloading, accessing, creating an account for, or using Jailhouse Poker, you agree to these Terms.

1. About Jailhouse Poker

Jailhouse Poker is an entertainment game featuring simulated poker and other card-game variants played using virtual chips.

Jailhouse Poker does not offer real-money gambling.

Virtual chips and other virtual items have no cash value, cannot be redeemed for money or prizes, cannot be withdrawn, cannot be exchanged for real-world currency, are intended solely for use within Jailhouse Poker, and may not be sold or transferred outside the game.

Winning or losing virtual chips in Jailhouse Poker does not result in winning or losing real money.

2. Eligibility

Jailhouse Poker is not directed to children under 13.

You may not use Jailhouse Poker if you are prohibited from doing so under applicable law.

If you are under the age of legal majority where you live, you should use Jailhouse Poker only with the permission and supervision of a parent or legal guardian.

Parents and guardians are responsible for supervising a minor's use of Jailhouse Poker, including any purchases made through an account or device under their control.

3. Accounts

Some features of Jailhouse Poker may require an account. Accounts may be created through available authentication methods, which may include guest access, Google Sign-In, and other authentication providers that may be added in the future.

You are responsible for maintaining control of your device, authentication accounts, and credentials.

You may not access another person's account without authorization; sell, rent, transfer, or give away your account; impersonate another person; attempt to obtain another user's credentials; or circumvent account restrictions or suspensions.

You are responsible for activity occurring through your account unless caused by a failure of our systems or security for which you are not responsible.

Guest Accounts

Guest accounts may depend on information stored on your device or other technical identifiers. If you uninstall the application, clear application data, change devices, lose access to the device, or otherwise remove information associated with a guest account, we may not be able to recover that account.

We encourage users to connect an available persistent authentication method if they want to reduce the risk of losing access to their account.

4. Virtual Chips and Virtual Items

Jailhouse Poker may provide virtual chips or other virtual items through gameplay, daily rewards, promotions, achievements, bonuses, purchases, or other in-game systems.

Virtual chips are licensed to you for use within Jailhouse Poker. They are not your personal property and do not represent stored monetary value.

We may establish rules regarding how virtual chips are earned and used, maximum or minimum balances, rewards, promotional chips, buy-ins, antes, game limits, and expiration of promotional items if applicable.

We may correct a virtual chip balance when necessary to address technical errors, duplicate rewards, failed or reversed transactions, fraud, exploits, unauthorized manipulation, or server or accounting errors.

Virtual chips may not be sold, exchanged, transferred for value, or converted into money, goods, services, prizes, cryptocurrency, or anything else of real-world value.

5. Purchases

Jailhouse Poker may offer optional purchases of virtual chips, virtual items, or other digital content.

Purchases may be processed through the application marketplace from which you obtained Jailhouse Poker, such as Google Play or another supported app marketplace. We do not directly receive or store your complete payment-card information when a purchase is processed by an application marketplace.

Prices are displayed before a purchase is completed. You are responsible for reviewing the price and purchase details before confirming a transaction.

Purchase Validation

We may use third-party services, including RevenueCat, to validate, process, synchronize, and manage purchase information. A purchase may need to be successfully validated before purchased virtual items are credited to your account.

Consumable Purchases

Virtual chips are generally consumable digital items. Once virtual chips have been credited and used in gameplay, they may not be capable of being restored in the same manner as non-consumable digital products.

Refunds

Refund eligibility is subject to the policies of the marketplace through which the purchase was made, our applicable refund policies, and applicable law.

If a purchase is refunded, reversed, canceled, charged back, or determined to be unauthorized, we may remove the virtual items or virtual value associated with that purchase to the extent reasonably possible. If those virtual items have already been used, we may make an appropriate adjustment to the account's virtual balance.

Nothing in these Terms limits any refund or consumer rights that cannot legally be waived.

6. Free and Promotional Virtual Chips

We may provide free or promotional virtual chips through daily rewards, gameplay rewards, promotional events, bonuses, or special offers. Promotional virtual chips have no cash value.

We may modify or discontinue promotional programs at any time and may correct or revoke rewards obtained through technical errors, duplication, exploits, fraud, or abuse.

7. Fair Play and Prohibited Conduct

Jailhouse Poker is intended to provide fair multiplayer gameplay. You may not:

  • Cheat or collude with other players
  • Manipulate game results
  • Use multiple accounts to gain an unfair advantage
  • Intentionally transfer value between accounts through coordinated gameplay
  • Use bots, scripts, automation, or unauthorized software to play on your behalf
  • Exploit bugs or vulnerabilities
  • Manipulate network traffic or game messages
  • Modify the application to bypass game rules
  • Attempt to alter server-authoritative game state
  • Interfere with matchmaking or multiplayer sessions
  • Fraudulently obtain virtual chips or purchases
  • Abuse reward systems
  • Circumvent purchase validation
  • Attempt unauthorized access to our servers, systems, APIs, or databases
  • Disrupt or impair Jailhouse Poker or its infrastructure

If you discover a vulnerability or exploit, you should report it rather than using it for personal advantage. We may investigate suspected cheating, fraud, exploitation, or abuse.

8. Player Conduct and Social Features

Jailhouse Poker may provide social or multiplayer features such as player names, friend systems, invitations, or communications.

You may not use those features to harass or threaten others, impersonate another person, engage in fraud or scams, post unlawful content, distribute malware, attempt to obtain passwords or financial information, or repeatedly disrupt another player's use of the service.

We may moderate, restrict, suspend, or remove access to social features when reasonably necessary to protect users or the service.

9. Account Suspension and Termination

We may temporarily or permanently restrict, suspend, or terminate an account when we reasonably believe that a user has violated these Terms, cheated, used exploits, engaged in fraud, manipulated purchases, threatened the security of the service, seriously or repeatedly disrupted other users, or violated applicable law.

Where appropriate, we may also remove improperly obtained virtual chips, reverse fraudulent rewards, restrict multiplayer access, or prevent creation of replacement accounts intended to evade enforcement.

Termination of an account does not create a right to receive cash for remaining virtual chips or virtual items. Nothing in this section limits rights that users may have under applicable consumer law.

10. Account Deletion

You may request deletion of your Jailhouse Poker account through the method provided in the application's Settings menu or through our external account-deletion page.

Deleting your account may permanently remove access to virtual chip balances, account progress, rewards, friends or social connections, saved settings, and other account-specific information.

Account deletion generally cannot be reversed after it has been completed. Deleting the application from your device does not by itself delete your account.

11. Privacy

Our collection and use of personal information is described in the Jailhouse Poker Privacy Policy. The Privacy Policy forms part of the terms governing your use of Jailhouse Poker.

12. Intellectual Property

Jailhouse Poker, including its software, artwork, graphics, user interface, characters, game presentation, logos, names, text, audio, and other original content, is owned by or licensed to Thatcher Enterprises, LLC and 607digital and is protected by applicable intellectual-property laws.

These Terms give you a limited, personal, revocable, non-exclusive, non-transferable right to use Jailhouse Poker for personal entertainment.

Except where permitted by law, you may not copy or distribute the application; reverse engineer protected portions of the application; sell or sublicense application content; remove copyright or ownership notices; use Jailhouse Poker branding in a manner that falsely suggests affiliation or endorsement; or commercially exploit our content without authorization.

13. Poker Variants and Game Rules

Jailhouse Poker includes traditional and original poker or card-game variants. Rules may differ substantially from conventional casino poker.

Rules displayed within Jailhouse Poker govern gameplay for the applicable variant. We may modify game rules, balancing, stakes, buy-ins, rewards, or gameplay systems as the service evolves.

Changes to gameplay rules do not give virtual chips any real-world monetary value.

14. Third-Party Services

Jailhouse Poker may rely on third-party services for authentication, app distribution, purchases, push notifications, cloud hosting, and multiplayer infrastructure. Your use of those services may also be subject to the provider's own terms and privacy policies.

We are not responsible for third-party services to the extent their operation is outside our reasonable control.

15. Updates and Changes to the Game

We may update Jailhouse Poker to add or remove features, modify gameplay, fix bugs, improve security, change compatibility requirements, balance game systems, or comply with legal or platform requirements.

Certain updates may be required to continue using online features. We do not guarantee that every feature, poker variant, reward, promotion, or online service will remain available indefinitely.

16. Service Availability

We aim to keep Jailhouse Poker available and reliable, but uninterrupted service cannot be guaranteed. The game may occasionally be unavailable because of maintenance, updates, server failures, network problems, security incidents, third-party service outages, or events outside our reasonable control.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Jailhouse Poker is provided on an “as is” and “as available” basis.

We do not guarantee that the service will always be available, always be error-free, remain compatible with every device, preserve all data indefinitely, or complete every multiplayer session without interruption.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Thatcher Enterprises, LLC, 607digital, and their owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Jailhouse Poker.

Because virtual chips have no cash value, loss of virtual chips does not constitute loss of money or property having equivalent real-world value.

Nothing in these Terms limits liability where limitation is prohibited by law.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or expenses resulting from your intentional unlawful conduct, fraud, unauthorized use of the service, or material violation of these Terms.

This provision does not require you to indemnify us for our own unlawful conduct or negligence where prohibited by law.

20. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Nothing in these Terms prevents a consumer from exercising legal rights that cannot be waived under the laws applicable where that consumer resides.

21. Changes to These Terms

We may update these Terms as Jailhouse Poker evolves. When we make material changes, we will update the “Last Updated” date above and may provide additional notice where appropriate.

Your continued use of Jailhouse Poker after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law. If you do not agree with revised Terms, you may stop using the service and request deletion of your account.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

23. Entire Agreement

These Terms and the Jailhouse Poker Privacy Policy constitute the agreement between you and us concerning your use of Jailhouse Poker, except for additional terms that may apply through an application marketplace or other third-party service.
